Terms of Service

1. Acceptance of Terms
By accessing or using the Kaila OS mobile application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Kaila OS is a voice-first AI personal assistant that helps you manage your calendar, tasks, notes, contacts, reminders, and other personal information, read and summarize your Gmail inbox when connected, and access and sync events to your Google Calendar for scheduling assistance, through natural language voice and text interactions. The Service uses artificial intelligence to understand your requests and perform actions on your behalf.
3. User Accounts
To use the Service, you must create an account. You are responsible for:
- Providing accurate account information
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit harmful, offensive, or illegal content
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service's operation
- Use the Service for any commercial purpose without our written consent
- Reverse-engineer, decompile, or disassemble any part of the Service
5. User Content
You retain ownership of all content you create through the Service, including calendar events, tasks, notes, contacts, and other personal data ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you.
You are responsible for your User Content and represent that it does not violate any third party's rights or any applicable law.
6. AI-Generated Responses
The Service uses artificial intelligence (powered by Google Gemini) to process your requests and generate responses. You acknowledge that:
- AI-generated responses may not always be accurate, complete, or up to date
- The Service is not a substitute for professional advice (medical, legal, financial, or otherwise)
- You should verify important information independently
- We are not liable for decisions made based on AI-generated responses
7. Third-Party Services
The Service integrates with third-party services including Google Gemini (AI processing), Google Places (location search), Google OAuth and Gmail API (email reading), Google Calendar API (calendar access), Tavily (web search), Firebase (push notifications), RevenueCat (subscription management), and third-party email delivery services (SMTP). Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.
8. Google API Services
Kaila OS's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. By connecting your Google account (Gmail or Google Calendar), you acknowledge that:
- You authorize Kaila OS to access your Google data as described in our Privacy Policy
- You may revoke access at any time through your Google Account settings
- Kaila OS will not use your Google data for purposes other than providing and improving the Service
- Kaila OS will not transfer your Google data to third parties except as described in our Privacy Policy
9. Intellectual Property
The Service, including its design, code, features, and branding, is owned by Kaila OS and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAILA OS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
12. Termination
You may stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, with reasonable notice where practicable.
Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, disclaimers, limitation of liability, and governing law survive termination.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the app and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Kaila OS operates, without regard to conflict of law principles.
